Of course we do know of numerous differences in the circumstances of Daley's attempt to "scare" the reporter, and Fox's alleged threat. Daley was in the same room as the reporter, talking to him from a few feet away, while Fox was calling from thousands of miles away. Daley was clearly holding ("brandishing," perhaps?) a weapon at the time of his intent to cause fear, while there would be no way of knowing over the phone whether or not Fox was actually armed. Finally, Daley was speaking to a reporter who presumably does not have a security detail, and cannot even legally own--much less carry--a handgun in Chicago, while Daley has tax-payer funded, heavily armed bodyguards to protect him.
