About Olofson

The renewed discussion about the massive injustice against David Olofson brought to my mind a point that I don't often see addressed.

David's GUNS Magazine article brought it up, but I haven't seen much mention of it elsewhere.

What mattered was the government’s position that none of the above was relevant because “[T]here’s no indication it makes any difference under the statute. If you pull the trigger once and it fires more than one round, no matter what the cause it’s a machine gun.”

No matter what the cause.

Think about if your semiauto ever malfunctions. Because that’s how close you could be to becoming a convicted “gun felon.”
See what I'm getting at? Most commentators who believe in Olofson's innocence (as I wholeheartedly do) focus on the BATFE's and prosecution's lies and dirty tricks--and that is certainly a rich vein.

Still, there's something else going on here; something that might be even more chilling.

Even if Olofson is "guilty" (of exercising his unalienable right--the one that shall not be infringed); even if the BATFE is trying something new, and telling the truth for once--that doesn't change the fact that according to the government, you can still be sent to prison for having a malfunctioning semi-auto, because "[i]f you pull the trigger once and it fires more than one round, no matter what the cause it’s a machine gun." In other words, a malfunction is no excuse, according to the government.

"Land of the free," my ass.

P.S. By the way, that relief fund for Mr. Olofson's family is still up for donations.

Guns don't kill people, morons with guns and gun rights kill people.

Interestingly, Mr. Bravely Anonymous, I know quite a few gun rights activists, and the few who have killed have only done so out of dire necessity. Ted Kennedy, on the other hand . . .

So obviously our Anonymous poster shouldn't be allowed to have guns.

Yeah--if he wants to base gun rights on IQ, I think I'll be considerably better armed than him.

Yes, as in government thinking it's the ONLY ONE that has the right.AAAAAGH, the perils of allowing children to vote and use computers.........Where's Bushmaster in all this? mthead

He's guilty as charged and BATF was right on busting that looser. I'm a proud NRA member and wouldn't stoop so low as to claim that moron as a gun rights poster-boy.

Anon 12:12, uh huh, except for the part where the original BATFE ruling was that his firearm was not a machine gun.

Except for the part that under the prosecution's theory a single shot .22 is a machine gun.

Except for the part where you are an idiot and a suck-up. Let me tell you something about sucking up. It doesn't do you any good if the suckee doesn't know who you are. So you should probably not post as "anonymous" anymore. You'll just get sore knees for no reward. Hell, even whores get paid. Of course, they are right there with the suckee in person and though they may not share their names, at least they are seen at the point of payment.

In your case, you should use your full name, in the event that you will not be recognized by face, voice or talent. Hey, just a tip. I just hate to see a working girl get cheated out of her earnings.

Oh great, another "I'm a gun owner, but..." guy. Anonymous, can you explain how keeping a family man who had a steady job locked up in federal prison is enhancing public safety? How is this different than a guy who ends up in the federal klink for growing a few pot plants in his basement? How is it different than Mrs. Raich, who did such a thing because she uses it medicinally?

This type of possession is a victimless crime, unless you believe that machine guns are somehow inherently dangerous to others just by their mere presence.
